Information on the processing of personal data

The company BeerBreaks.com, s.r.o. processes your personal data for the purpose of sending you commercial communications (marketing offers) based on so-called legitimate interest. You can object to this processing of your personal data at any time and commercial communications will no longer be sent to you.   1. IDENTITY AND CONTACT DETAILS OF THE CONTROLLER

    1. The controller of your personal data is the company BeerBreaks.com, s.r.o., with registered office at Příčná 1892/4, Nové Město, 110 00 Prague 1, company ID 142 35 561, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, entry no. 361558 (hereinafter referred to as the "Controller").

    2. The contact details of Controller are as follows: delivery address Příčná 1892/4, Nové Město, 110 00 Praha 1, Czech Republic, e-mail address info@beerbreaks.com.

    3. Controller did not appoint a data protection officer.

  2. LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA

    1. The legal basis for the processing of your personal data is that such processing is necessary for the purposes of the legitimate interests of Controller or a third party within the meaning of Article 6(1)(f) of Regulation 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the "Regulation").

    2. This information obligation is fulfilled in relation to personal data processed by Controller solely for the purpose of sending commercial communications based on the legitimate interests of Controller. It does not apply to the processing of personal data carried out by Controller for other purposes and on another legal basis, in which case the information obligation will be fulfilled separately by Controller.

  3. PURPOSE OF THE PROCESSING OF PERSONAL DATA

    1. The purpose of the processing of your personal data is the sending of commercial communications by the administrator to your person within the meaning of the act no. 480/2004 Coll., on Certain Information Society Services and on amendments to certain acts (Act on Certain Information Society Services), as amended (hereinafter referred to as the "Act on Certain Information Society Services").

    2. There is no automatic individual decision-making by Controller within the meaning of article 22 of Regulation.

  4. LEGITIMATE INTERESTS OF THE CONTROLLER

    1. You have been a customer (user) of Controller within the meaning of Section 7(3) of Act on Certain Information Society Services and at the same time Controller has provided you with the opportunity when collecting your personal data to clearly, distinctly, free of charge and in a simple manner not to consent to the use of your electronic contact details for sending commercial communications.

    2. When sending commercial communications, Controller complies with generally binding legal regulations, in particular the provisions of section 7 of Act on Certain Information Society Services.

    3. Recital 47 of Regulation states, inter alia, that "processing of personal data for direct marketing purposes may be regarded as processing carried out for legitimate interest."

    4. Controller has carried out an assessment of whether it is possible to process your personal data for the purpose of sending commercial communications and has also carried out the necessary proportionality test, balancing the interests in protecting you against the interests of the controller. The controller has concluded that, in view of the previous fulfilment of the prerequisites set out in section 7(3) of Act on Certain Information Society Services, and in view of the fact that you may at any time refuse the further sending of commercial communications to you, it does not appear that your interests or fundamental rights and freedoms requiring the protection of the personal data voluntarily provided by you take precedence over the Controller's legitimate interests in sending commercial communications.

    5. In view of the above and the fact that you could have reasonably expected the processing of your personal data for the purpose of sending commercial communications, Controller considers that the legal basis for the processing of your personal data for the purpose of sending commercial communications to you is the legitimate interest of Controller (article ‎2.1).

  5. STORAGE PERIOD OF PERSONAL DATA

    1. Your personal data will be processed by Controller for a period of three (3) years from the termination of the contract with Controller, but no longer than until you object or make a similar request against the processing of personal data for the purpose of sending commercial communications from your side, including exercising the right to erasure of your personal data.

  6. OTHER RECIPIENTS OF PERSONAL DATA

    1. Other recipients of your personal data will be persons providing technical services related to the operation of the software or sending commercial communications (as processors) for Controller based on Controller's instructions.

    2. Controller does not intend to transfer your personal data to a third country (to a country outside the EU) or to an international organization.

  7. RIGHTS OF THE DATA SUBJECT

    1. Under the conditions set out in Regulation, you have the right to request from Controller access to your personal data, the right to rectification or erasure of your personal data, or restriction of their processing.

    2. If you believe that the processing of your personal data has infringed or is infringing Regulation, you have the right, among other things, to file a complaint with a corresponding supervisory authority.

    3. You have the right to object at any time to the processing of your personal data for direct marketing purposes, including profiling, where the profiling relates to such direct marketing. If you object to the processing of your personal data for direct marketing purposes, your personal data will no longer be processed for these purposes. This is without prejudice to the processing of your personal data based on another legal basis or for another purpose.
