Legal basis for processing personal data
The legal basis for processing your personal data is the legitimate interest of the Controller or a third party, as provided in Article 6(1)(f) of Regulation 2016/679 of the European Parliament and of the Council (General Data Protection Regulation, "Regulation").
This information applies only to personal data processed by the Controller for the purpose of sending commercial communications. Any other processing of personal data for different purposes will be addressed separately by the Controller.
Purpose of processing personal data
The purpose of processing your personal data is to send you commercial communications in accordance with Act no. 480/2004 Coll., on Certain Information Society Services and its amendments (the "Act").
No automated decision-making, as described in Article 22 of the Regulation, takes place during this processing.
Legitimate interests of the controller
You have been a customer of the Controller under Section 7(3) of the Act, and the Controller gave you an opportunity to object to the use of your contact details for marketing purposes at the time of data collection, free of charge and in a clear manner.
The Controller complies with Section 7 of the Act when sending commercial communications.
Recital 47 of the Regulation states that processing personal data for direct marketing purposes may be considered a legitimate interest.
The Controller has assessed whether processing your personal data for marketing is justified and conducted a proportionality test. Based on this, the Controller determined that your rights and freedoms are not overridden by the legitimate interests of the Controller in sending commercial communications, as you can opt out at any time.
Given this, and the reasonable expectation that your data would be used for marketing purposes, the Controller considers its legitimate interest to be the legal basis for processing your personal data for commercial communications.
Storage period of personal data
Your personal data will be processed for a period of three (3) years from the termination of your contract with the Controller, or until you object to or request the erasure of your personal data for this purpose.
Other recipients of personal data
Recipients of your personal data may include service providers who assist the Controller with technical operations related to sending commercial communications (acting as processors on behalf of the Controller).
The Controller does not intend to transfer your personal data to a third country (outside the EU) or to an international organization.
Rights of the data subject
Under the Regulation, you have the right to request access to your personal data, the right to rectification or erasure, and the right to restrict processing.
If you believe your personal data has been processed unlawfully, you have the right to file a complaint with a supervisory authority.
You have the right to object at any time to the processing of your personal data for direct marketing purposes. Once you object, your personal data will no longer be processed for marketing purposes. This does not affect other processing based on different legal grounds.
